Terms of Service

These Terms of Service ("Terms") govern your access to and use of PixelSEO.ai ("the Service"), operated by Chris Cagle, a sole proprietor located in Caldwell, Texas ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. We do not knowingly permit users under 13 to create accounts. If we become aware that a user is under 13, we will terminate their account and delete associated data.

2. Account Registration

You must create an account to access most features of the Service. Account authentication is managed by Clerk. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to keep it current.

3. Credits and Payment

The Service operates on a credit-based system. Credits are used to generate images, SEO metadata, and related outputs.

• Free accounts receive a limited number of credits upon registration.
• Additional credits may be purchased through the Service. Payments are processed by Stripe.
• All purchases are final and non-refundable. Once credits are purchased, they cannot be returned or exchanged for cash, regardless of whether they have been used.
• Credits have no cash value and are not transferable between accounts.
• We reserve the right to modify credit pricing at any time. Price changes will not affect credits already purchased.

4. API Access

Access to the PixelSEO.ai API is subject to these Terms. You agree not to use the API in a manner that exceeds your purchased credit allowance, violates applicable law, or degrades service performance for other users. We reserve the right to rate-limit or suspend API access for any account that violates these Terms.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, obscene, or infringes on the intellectual property rights of others
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service
• Use automated means to access the Service in ways that bypass normal usage patterns
• Impersonate another person or entity
• Upload or prompt for content involving minors in a sexual or harmful context

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

Your content: You retain ownership of the images you generate and the prompts you submit. By using the Service, you grant us a limited license to process and store your content solely to provide the Service.

Our content: The Service, including its design, software, branding, and non-user-generated content, is owned by us and protected by applicable intellectual property law. You may not copy, reproduce, or distribute any part of the Service without our written permission.

7. Generated Images and SEO Outputs

Generated images are stored on Cloudflare infrastructure for up to 12 months from the date of creation. After that period, they may be deleted without notice. You are responsible for downloading and retaining any generated content you wish to keep beyond that window.

We do not claim ownership over images or SEO metadata you generate using the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated outputs will meet your specific requirements. SEO results, rankings, and outcomes are not guaranteed.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Burleson County, Texas.
